Notice of Privacy Rights of California Residents
- Types of Information Collected
The Sites may collect two types of information about users: Personally Identifiable Information and Non-Personally Identifiable Information.
“Personally Identifiable Information” includes, without limitation, non-public information about you that helps Case Yard identify you, such as first and last name, birthdate, email address, street address, telephone number, credit or debit card number or other payment method, billing and shipping information, order history, and financial information.
“Non-Personally Identifiable Information” includes, without limitation, information that does not personally identify you as the individual to whom the information relates, such as information that is aggregated by Case Yard or a third party, or information that is not linked to contact information or other Personally Identifiable Information about you, such as your Internet Protocol (“IP”) address, browser type, operating system, general geographic location, domain name of your internet service provider, cookies and other Collection Technology information (described below), general information about whether Site users click on Case Yard digital ads and what sites they are on when they click on such ads, the frequency of Site visits, pages requested, number of users, activities while visiting the Site, content accessed, Products purchased on the Sites, and the like.
In addition, Case Yard may collect information about you, such as your password, device, mobile carrier, preferences and interests, demographic information, precise geographic location, shopping habits, Site usage, age and gender. In the event that such information is maintained with your name or contact information, it will be treated as Personally Identifiable Information; otherwise, such information will treated as Non-Personally Identifiable Information.
- How We Collect Personally Identifiable Information
General: Personally Identifiable Information is collected online by us or our service providers on our behalf when users register to open an account or update their account, create or update a profile, place orders or make purchases, communicate with us about orders or other questions, post comments, enter or participate in Activities, or use Communication Services. We also may collect information about your transactions and interactions with us and our franchisees, vendors and advertisers, including information about your use of Products offered through the website. We may collect information about you from other sources, such as blogs, public resources, third parties and other users of the Sites and our Services. In addition, Personally Identifiable Information may be collected offline and through a Case Yard mobile application and social media, as described below.
Mobile: If you use mobile-enabled services provided by Case Yard, such as any Case Yard mobile application made available by us, we may receive information about your use of our Services from your mobile device. This may also include information about your precise location if you have enabled location-based services on your mobile device.
Social Media: Certain information you post or provide through parts of the Sites that are available to others, such as your name, profile, comments, collections and reviews, may be shared with other users and posted on publicly available portions of sites. Please keep in mind that if you choose to disclose Personally Identifiable Information when posting comments or other information or content through the Sites, this information may become publicly available and may be collected and used by others, including people outside the Case Yard community. It is up to you to make sure you are comfortable with the information you choose to provide Case Yard and the information you choose to include in your Submissions. Your Submissions may be available to Site users and to users of other websites and services; Case Yard will not have any obligations with respect to any information that you include in your Submissions. We recommend that you use caution when giving out Personally Identifiable Information to others through social media networks or otherwise, as such information may be or become publicly available. You can protect Personally Identifiable Information by not including identifying information in your Submissions.
- How We Collect Non-Personally Identifiable Information
General: Non-Personally Identifiable Information is collected automatically on our server logs from your browser, as well as through other analysis of the Sites. Non-Personally Identifiable Information is also collected through cookies, other Collection Technology, IP Addresses and Google Analytics, as well as from third parties and feedback Case Yard receives, as described below.
You can set your browser not to accept cookies. You may use the Sites even if you choose to reject or delete the cookies. However, if you do, you may not be able to take full advantage of the features of the Sites. To enable or disable cookies on your browser, please consult your browser documentation or contact your software provider.
Pixel Tags/Clear GIFs/Web Beacons: A pixel tag, also known as a clear GIF or web beacon, is an invisible tag that may be placed on certain pages of the Site but not on your computer (“Collection Technology”). When you access these pages, pixel tags generate a generic notice of that visit. They usually work in conjunction with cookies, registering when a particular computer visits a particular page. If you turn off cookies the pixel tag will simply detect an anonymous website visit.
IP Address: We may use your IP address to analyze trends, administer the Sites and gather broad demographic information for aggregate use to improve the Sites; in doing so, we will not link your IP address to your Personally Identifiable Information.
You can opt-out from being tracked by Google Analytics in the future by downloading and installing Google Analytics Opt-out Browser Add-on for your current web browser at http://tools.google.com/dlpage/gaoptout?hl=en.
Third Parties: Case Yard also may acquire Non-Personally Identifiable Information from other sources (such as offline records or publicly available information) and from vendors and other third parties, some of which partner with Case Yard or with an advertisement network utilized by Case Yard. Non-Personally Identifiable Information also may be obtained by these other sources from inferences based upon the sites you visit, third party data, information you share on other websites, social media platforms and applications, or demographics derived from profiles or accounts that you create, to the extent permitted in their privacy policies.
- Children and Privacy
Case Yard and the Sites do not knowingly collect Personally Identifiable Information from children under age 13. If you are under age 13, you are not permitted to use the Sites or to submit any Personally Identifiable Information to the Sites. If you are between 13 and 17 years of age, you may post messages, but you may not submit any Personally Identifiable Information. If we become aware that a Site user is under age 18 and has provided Personally Identifiable Information, we will take steps to remove his or her Personally Identifiable Information from our files. If you are a parent or guardian and believe Case Yard may have inadvertently collected personally Identifiable information from your child, please notify Case Yard immediately by sending an email to email@example.com.
- Use and Disclosure of Personally Identifiable Information
General: Case Yard and its affiliates, vendors and franchisees may use your Personally Identifiable Information to process and fulfill orders, ship and confirm orders, administer and process payments, provide customer service, update account and profile information, post Submissions, administer Activities, improve your Site experience and Case Yard’ Products and Services, forward promotional emails and postal mail, forward updates and announcements, and communicate with you about the Site, Activities, Communication Services, and the Products and Services of Case Yard and its affiliates. Case Yard also may use Personally Identifiable Information to send you information about third parties who may have Products or Services of interest to you.
Case Yard may combine Personally Identifiable Information collected through the Sites with information available from other sources (such as offline records or publicly available information). We will treat the combined information as Personally Identifiable Information.
Requested and Promotional Email: You authorize Case Yard to transmit email to you to respond to your questions or address your orders, billing or use of Communications Services. In addition, if you have an account or profile, you agree that Case Yard is authorized to send you announcements, updates and informational and promotional emails and postal mail from Case Yard and on behalf of its affiliates, franchisees, vendors and advertisers, and to make offers to you from Case Yard or from third parties who may have Products or Services of interest to you. If you participate in Activities, you agree that Case Yard is authorized to contact prospective winners by telephone and send information, documents and prizes to you by email or postal mail, as provided in the applicable rules. Unsubscribe instructions are included in each promotional email.
Service Providers and Other Third Parties: Case Yard may disclose Personally Identifiable Information to third parties that we may hire to perform services on our behalf. We may share Personally Identifiable Information and Non-Personally Identifiable Information with our service providers, shippers, vendors, advertisers, consultants, franchisees and affiliates for our internal business purposes, Site analysis or administration, communications with users, order payment and fulfillment, order delivery, marketing or similar activities. Case Yard also may share your Personally Identifiable Information with third parties for their direct marketing purposes.
Legal and Safety Reasons: Case Yard may disclose Personally Identifiable Information as required by applicable law or as necessary or advisable to: (a) protect Case Yard’ rights, safety or property or the rights, safety or property of others; (b) enforce the Terms; (c) respond to your orders or requests for customer service or other information; (d) comply with legal process or cooperate with law enforcement or governmental requests; (e) investigate, prevent or take action regarding suspected illegal activities, fraud or potential threats, or exercise legal rights or defend against claims; or (f) comply with or as permitted by applicable laws and regulations.
Major Transaction: Case Yard reserves the right to transfer any and all information, including without limitation Personally Identifiable Information, collected from Site users to an affiliate or third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or disposition of all or any portion of our business or operations (including without limitation in connection with bankruptcy or any similar proceedings).
- Use and Disclosure of Non-Personally Identifiable Information
Additionally, we may take personally identifiable information and de-identify it and share it in a de-identified or aggregated form with third parties to show or analyze site usage, improve our services, improve our user experience, or for similar purposes.
Advertising: Case Yard also may use your Non-Personally Identifiable Information to present you with targeted content and advertisements (including on third party websites and apps) based on your past visits to the Sites and your Non-Personally Identifiable Information collected over time by us and third parties. Such targeted content and advertisements may include marketing for the Sites, Products, Services or the sites, products and services of Case Yard’ business and advertising partners. Your Non-Personally Identifiable Information also may be used to analyze and develop advertisements and advertising campaigns, provide you with special offers and promotions and determine the effectiveness of same, optimize and determine the effectiveness of content and advertisements, analyze your interactions with the content and advertisements you are presented with, and how same relates to your visits to the Sites. Case Yard does not share any of your Personally Identifiable Information with our remarketing ad networks or advertisers.
Opt Out: Some of our third party partners may participate in the Digital Advertising Alliance’s Self-Regulatory Program for Online Behavioral Advertising and allow consumers the ability to opt-out of targeted advertising based on web activity tracking. Please note that even if our third party partners participate in the Digital Advertising Alliance’s Self-Regulatory Program for Online Behavioral Advertising and you opt of targeted advertising based on web activity tracking, you still may receive standard advertisements from us and targeted advertisements from third parties after clicking the link and following the instructions provided therein. You may need to re-click the link and follow the instructions provided therein if you delete cookies or other Collection Technology or use a different computer, device or browser.
- Information Removal/Opt-Out
You are responsible for keeping your Personally Identifiable Information current. You may update your Personally Identifiable Information or change your preferences in your account or in your profile by visiting your My Profile page, or by sending an email to firstname.lastname@example.org. You may not opt out of receiving communications regarding your purchases, your dealings with the Sites, or technical information about the Sites.
If you prefer not to receive marketing or promotional emails from Case Yard, you may click on the “Unsubscribe” link in any promotional email you receive from us and follow the “Unsubscribe” instructions. Please note that such requests may take up to ten (10) days to become effective.
- Notice of Privacy Rights of California Residents
If you are a California resident and have provided Personally Identifiable Information to Case Yard, you are entitled by law to request certain information regarding any disclosure that may have been made by Case Yard to third parties of Personally Identifiable Information for their direct marketing purposes. To make such a request, send an email to email@example.com, specifying that you seek your “California Customer Choice Privacy Notice.” Please allow thirty (30) days for a response. Case Yard is required to respond to only one request per customer each year, and is not required to respond to requests made by means other than through the above email address.

- Protection of Personally Identifiable Information
Case Yard uses reasonable administrative, physical and electronic security measures to protect against the loss, misuse and alteration of your Personally Identifiable Information.
No transmission of data over the internet is guaranteed to be completely secure. It may be possible for third parties not under the control of Case Yard to intercept or access transmissions or private communications unlawfully. While we strive to protect your Personally Identifiable Information, neither Case Yard nor our service providers can ensure or warrant the security of any information you transmit to us over the internet. Any such transmission is done at your own risk.
